R&B singer Bobby Brown was arrested Monday on suspicion on DUI, the Associated Press reports.

Brown, the ex-husband of Whitney Houston, was pulled over for talking on a cellphone shortly after noon Monday, according to the AP. An officer then noticed that Brown seemed to be impaired. The singer failed a field sobreity test, was booked on suspicion of DUI and was released later that afternoon.

TMZ was first to report the arrest.

Brown was convicted of drunk driving for a 1996 arrest in Georgia. He is currently on tour with the group New Edition.

Update: Brown’s attorney has released a statement to E! News: “Everyone is innocent until proven guilty and Mr. Brown was not driving erratically. He was speaking on his cell phone. Mr. Brown has not been convicted of anything associated with this incident.”
