Maryland's second-highest court has thrown out the murder conviction of an Annapolis man accused of shooting a man after a dispute over a cell phone.
Monday's ruling by the Court of Special Appeals raised the question of whether Andrew Tuell and his lawyer were informed of notes sent by the jury to the judge.
The case will return to Anne Arundel County Circuit Court for a hearing to determine whether the judge made the defense aware of the notes. The hearing could lead to a new trial.
Tuell was convicted in the fatal shooting of Terrence Powell in 2007. Prosecutors alleged that Tuell shot Powell to get a friend's cell phone back.
The issue of undisclosed jury notes could also result in a new trial for two men convicted in the near-beheadings of their three young relatives in Baltimore.
